Welcome to Dragon Notes. These Terms of Service ("Terms") govern your access to and use of the Dragon Notes iOS application and related services (the "Service") provided by Dragon Notes ("we," "our," or "us"). By downloading, installing, or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. You must be at least 13 years old to use Dragon Notes.

2. Description of Service

Dragon Notes is a meeting recording and productivity application for iOS that provides:

• Audio recording of meetings and conversations
• AI-powered transcription of audio recordings
• Automated generation of meeting notes, summaries, and action items
• PDF export and sharing of transcriptions and notes
• Audio playback of recorded meetings
• Optional cloud synchronization and storage of files

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

4. Subscription Plans and Billing

Dragon Notes offers the following plans:

• Free Trial: Includes a one-time allowance of 150 minutes of recording and transcription at no charge, with access to core features including AI transcription, meeting notes, audio playback, and PDF export.
• Pro Plan (Monthly): $9.99 per month, including 600 minutes of recording and transcription, cloud sync and storage, priority support, and all premium features.
• Pro Plan (Annual): $7.99 per month, billed annually at $95.88 per year, with the same features as the monthly Pro plan.

Subscriptions are managed through the Apple App Store. All billing, renewals, and cancellations are handled according to Apple's terms and policies. Prices are subject to change with reasonable notice provided to existing subscribers.

5. Cancellation and Refunds

You may cancel your subscription at any time through the App Store. Upon cancellation, your Pro features will remain active until the end of your current billing period. Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Record conversations without the consent of all parties where required by law
• Use the Service to violate any applicable local, national, or international law or regulation
• Reverse-engineer, decompile, or disassemble the Service or any part thereof
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
• Use the Service to transmit malicious software or harmful code
• Share your account credentials with others or allow unauthorized access to your account

7. Intellectual Property

The Service, including all content, features, design, code, logos, and trademarks, is owned by Dragon Notes and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain full ownership of all audio recordings, transcriptions, notes, and other content you create using the Service. By using cloud sync, you grant us a limited license to store and transmit your content solely for the purpose of providing the Service to you.

8. Recording Consent and Compliance

You are solely responsible for complying with all applicable laws regarding the recording of conversations, including obtaining necessary consent from all parties. Laws regarding recording consent vary by jurisdiction. Dragon Notes is not responsible for any legal consequences arising from your use of the recording features.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy of AI-generated transcriptions, summaries, or action items. You should verify important information independently.

10. Limitation of Liability

To the maximum extent permitted by law, Dragon Notes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dragon Notes and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dragon Notes operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the competent courts of that jurisdiction.
